Benefits Corner: Manage Legitimate Absences while Minimizing Abuse on March 13 It has been estimated that more than 60 percent of employers suspect they have given family and medical leave that was unwarranted. With good reason, however, employers tend to be cautious when questioning a Family and Medical Leave Act (FMLA) request: according to the Equal Employment Opportunity Commission, employees who successfully sue for wrongful termination based on an FMLA absence receive an average of $87,500 to $450,000 in damages. By having a plan to handle FMLA absences, HR managers can ensure that employees who need the time off receive it, while cutting down on the amount of unjustifiable cases.
